iOverlander is dedicated to providing the best possible service to overlanders worldwide, but not at the expense of your personal privacy. We require some personal data from you in order to effectively provide our services, but we always strive to do so with your consent and with transparency.

Introduction
iOverlander LLC (“us”, “we”, or “our”) operates www.ioverlander.com and iOverlander and iOverlander 2 mobile applications (hereinafter referred to as “Service”). Our Privacy Policy governs and explains how we collect, safeguard and disclose information that results from your use of our Service.

We use your data to provide and improve Service. By using Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meaning as in our Terms of Service.

Our Terms of Service (“Terms”) govern all use of our Service and together with the Privacy Policy constitutes your agreement with us (“agreement”).

Data Collected

We collect several different types of information for various purposes to provide and improve our Service.

When you create an account, we may collect your username, email address, first and last name, blog name, blog URL and location. As you interact with us and our Service, we may also collect other data that you directly provide to us, which may include places you add or edit, pictures that you choose to upload, check-ins, comments, and any other data that you voluntarily provide to us.

We may use and store information about your location if you give us permission to do so (“Location Data”). We use this data to provide features of our Service, to improve and customize our Service. We may use various technologies to determine your location, such as the location services of your web browser, GPS data from your device or cell tower data. You can enable or disable location services when you use our Service at any time by way of your device or browser settings.

We may also collect additional data about you when you use our services. For example, we receive data:

  • relating to how you interact with our services, such as what pages you view, your access times, the time you spend on each page;
  • your computer’s or your mobile devices Internet Protocol address (e.g. IP address),
  • relating to your device, such as your hardware model, your mobile device unique ID, operating system, browser type, and language; and

Data Usage

To operate and improve our services
We may use your data to operate and maintain our services. We may also use your data for research and development, to improve our apps and website, or to offer new features and tools, but only to the extent that this complies with our Terms of Service, this Privacy Policy, and applicable laws. For example, we may also use your data to customize our apps and website to provide you with your own unique experience. Or we may use this data to redesign our apps and websites to make a better experience for all users.

Communicate with you
We may also use your data to provide you with customer support or to detect and address technical issues. If you consent to sharing crash data with us, we may use that data to help us analyze the cause of the problem. We may use your data to provide notices about your account and/or subscription, including expiration and renewal notices, billing, email-instructions, etc.

We may use your email address to communicate with you about issues with any of your submitted data, or critical updates to our Services. We may also contact you with marketing material which may be of interest, but only with your consent.

Protection of our rights
We may use your data if legally required to protect the rights, property or safety of iOverlander, our users, staff members, or any third party.

Data sharing

We neither rent nor sell personal data of our users. Though, as described more fully in our Terms of Service, we may license or otherwise transfer certain data to third parties.

User submissions. User submitted data (including but not limited to place reviews, reported problems, points of interest or check-ins), is shared publicly with all users of the Service. The Service also shares your username, blog name and blog URL. We do not share your email address, unless you make it available in a comment or place description. This publicly visible data may be searchable by search engines and be shared with or disclosed to third parties.

Business Transaction. If we, or our subsidiaries, are involved in a merger, acquisition or asset sale, your Personal Data may be transferred.

Disclosure for Law Enforcement. We may share your data when we believe in good faith that such release is necessary to comply with law or a legal process, including laws outside your country of residence; to protect our rights, property, or safety, of our services and others.

Other cases: iOverlander may use third party service providers to provide or perform services on our behalf. In these cases, we may need to share your data with them. Our subsidiaries and affiliates, service providers, vendors and contractors, will only be allowed to process data in accordance with our prior written instructions.

How do I access or delete my data?

You may access and update your data at any time through the “My Account” tab on the iOverlander website. To view every location that you have checked-in to you may view your check-in history on the apps, or visit your My Check-ins page on the website. You may also request a copy of your data by emailing [email protected].

You may also delete your account at any time by going to your profile and clicking Cancel My Account. If you delete your account, we will remove your email address and username. If you wish to also remove your check-in history, blog url or blog name, please contact us at [email protected].

We will not be able to restore your account once it has been deleted. Residual copies of your data may remain on backup media for a period of time afterwards. Additionally, we may store certain data that is not considered your personal data, i.e. does not directly identify you. We may also retain data as required by applicable law.

Can I opt out?

At this time iOverlander does not participate in any interest-based marketing or advertising to our users. If in the future we do provide any marketing email, we will always have an easy way to opt-out from these communications.

Your Legal Rights

Subject to applicable law, you may have a number of rights regarding the processing of your personal data, including:

  • the right to request access to or copies of your personal data;
  • the right to request correction of any inaccuracies in your personal data;
  • the right to request deletion of your personal data;
  • the right to object to our processing of your personal data;
  • the right to request restriction of processing of your personal data;
  • right to withdraw that consent to process data;

Analytics

iOverlander may place cookies on our website or apps to help keep track and receive reports about how visitors are using our sites and services. Our aim in gathering this information is to improve our services to better meet your needs.

We use third parties to obtain some user information. These third parties may share this tracking information if they are legally obliged to do so.

  • Google Analytics: Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.   • Firebase: Firebase is analytics service provided by Google Inc. You may opt-out of certain Firebase features through your mobile device settings, such as your device advertising settings or by following the instructions provided by Google in their Privacy Policy.

Advertising

We may use third-party Service Providers to show advertisements to you to help support and maintain our Service.

  • We use Google AdSense to display ads on some of our pages or apps. Google AdSense may use user data. You can opt out of Google’s use of cookies or device identifiers by visiting Google’s Ads Settings. Alternatively, you can opt out of a third-party vendor’s use of cookies here or control the use of device identifiers by using their device’s settings explained here
  • AdMob by Google. AdMob by Google is provided by Google Inc. You can opt-out from the AdMob by Google service by following the instructions described by Google. Other Service Providers

We may also use third-party Service Providers to manage user accounts and subscriptions related to our Service:

  • RevenueCat. RevenueCat handles subscriptions and in-app purchases. We may share your personal data with RevenueCat to help us validate receipts, manage subscription transactions, restore purchases, and synchronize purchase statuses across various devices. RevenueCat provides us with data on when a user first used the app and with information about purchased subscriptions. Further details, please refer to the RevenueCat privacy policy.
  • hCaptcha: This site is protected by hCaptcha and its Privacy Policy and Terms of Service apply.

Payments

We may provide paid products and/or services within Service. In that case, we use third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. The payment processors we work with are:

Children under 13

None of the services offered by iOverlander are directed to individuals who are under 13 years of age. We do not knowingly collect any data from children under 13.

Personal data retention

The criteria for determining the duration for which we will keep your personal data are as follows: we will retain copies of your data only for as long as is necessary in connection with the purposes set out in this Privacy Policy, unless applicable law requires a longer retention period. In addition, we may retain your data for the duration of any period necessary to establish, exercise or defend any legal rights.

International users

Our apps, website and our data, including your data, are hosted on servers in the United States. If you are using iOverlander’s services from outside of the United States, your data will be processed and stored in the United States. As a result, United States federal and state governments, courts, or law enforcement or regulatory agencies may be able to obtain your data through applicable laws. These may or may not be the same privacy protections as the law of your jurisdiction.

iOverlander may amend this Privacy Policy from time to time. We encourage you to regularly check this page and review any changes we might make to this Privacy Policy. If we make substantial changes in the way we use your data, we will notify you by posting an announcement on our websites or apps, or by sending you an email (if we have your email).
